This site and its associated data processing activities are governed by all applicable legislative and regulatory texts, including in particular the following.

LCEN — Law n°2004-575

Law on Confidence in the Digital Economy

Governs the obligations of website publishers and online service providers, including legal notices, hosting provider liability and electronic communications.

GDPR — EU 2016/679

General Data Protection Regulation

European regulation applicable since 25 May 2018, defining the rights of data subjects and the obligations of data controllers regarding the collection and processing of personal data.

French Tax Code — Art. 293 B

General Tax Code

The publisher is subject to the VAT exemption regime provided for in Article 293 B of the French General Tax Code. Accordingly, VAT does not apply to services provided.

Technical Hosting

Pursuant to Article 6 I 2° of French law n°2004-575 of 21 June 2004, this site is hosted on a dedicated physical infrastructure owned exclusively by the Publisher, operated under the following conditions.

The Publisher reserves the right to migrate the hosting infrastructure to professional hosting providers, depending on availability, performance and capacity requirements linked to service growth. Any infrastructure migration will result in an update of these legal notices within a reasonable timeframe.

Article IV

Intellectual Property

This site and the ApsionScan application constitute works of the mind within the meaning of the French Intellectual Property Code. All constituent elements of the ApsionScan software, including without limitation the source code, object code, algorithms, data structures and graphical interfaces, are protected by copyright pursuant to Articles L.111-1 et seq. of the French Intellectual Property Code.

Software protection

The source code and object code of the ApsionScan application constitute an original software work, protected by copyright pursuant to Articles L.111-1 and L.335-2 to L.335-4 of the French Intellectual Property Code, as well as international conventions relating to the protection of computer programs. Any reproduction, decompilation, disassembly, adaptation, distribution or commercial exploitation, in whole or in part, without the prior written authorisation of the Publisher, is strictly prohibited.

Open source components

The ApsionScan platform integrates software components placed under free and open source licences. These components remain subject to their respective licences, which are not affected by these provisions. The use of open source components shall not constitute a waiver of the Publisher's rights over original developments made.

Editorial note

The editorial content elements of the marketing site (texts, visuals, iconography) are not entirely covered by this intellectual property clause and may, in some cases, be subject to open source licences or third-party rights.

Article V

Personal Data Protection

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR) and French law n°78-17 of 6 January 1978 known as the Data Protection Act as amended, the Publisher implements the following data processing activities.

Data controller

The data controller within the meaning of Article 4 §7 of the GDPR is Alexandre Perverie, acting as an individual entrepreneur under the trade name ApsionScan, reachable at apsionscan@gmail.com.

Purposes & legal bases

  • Management of client accounts and subscribed companies — legal basis: performance of a contract (Art. 6 §1 b) GDPR)
  • Service security, fraud and abuse prevention, verification of compliance with terms of use — legal basis: legitimate interest (Art. 6 §1 f) GDPR)
  • Service improvement through statistical analysis of usage — legal basis: legitimate interest (Art. 6 §1 f) GDPR)

Rights of data subjects

Pursuant to Articles 15 to 22 of the GDPR, you have the following rights:

  • Right of access to your data (Art. 15 GDPR)
  • Right to rectification (Art. 16 GDPR)
  • Right to erasure / right to be forgotten (Art. 17 GDPR)
  • Right to restriction of processing (Art. 18 GDPR)
  • Right to data portability (Art. 20 GDPR)

Data Protection Officer

Pursuant to Article 37 of the GDPR, the Publisher is not subject to the obligation to appoint a Data Protection Officer (DPO), as the processing operations implemented do not, at this stage, involve large-scale processing of special categories of data within the meaning of Articles 9 and 10 of the GDPR, nor systematic and large-scale monitoring of natural persons. Any request relating to data protection may nevertheless be addressed directly to the Publisher at the aforementioned email address.

Transfers outside the European Union

Pursuant to the provisions of Chapter V of the GDPR (Articles 44 to 49), personal data collected in the context of this service is not transferred to third countries or international organisations located outside the European Union or the European Economic Area. All data processing is carried out on infrastructure located on French territory.

Retention periods

  • Connection logs (IP, OS, device): 1 year, pursuant to French law n°2004-575 and CNIL recommendations
  • Account and subscribed company data: duration of contract plus 5 years under the commercial limitation period (Art. L110-4 French Commercial Code)
  • Billing data: 10 years, pursuant to statutory accounting obligations
  • Anonymised usage statistics: indefinite retention (non-re-identifiable data)

In the event of an unresolved complaint, you have the right to lodge a complaint with the competent supervisory authority, namely the French data protection authority (CNIL): www.cnil.fr

Sub-processors

The Publisher may use Resend (transactional email routing provider) for the transmission of electronic communications necessary for the operation of the service. This provider acts as a sub-processor within the meaning of Article 28 of the GDPR and is subject to corresponding obligations.

Article VI

Technical Collection & Trackers

This site does not use any advertising tracking or third-party profiling cookies. However, in the context of service delivery and in accordance with the legitimate interest legal bases referred to in Article 6 §1 f) of the GDPR, certain technical data are collected by client-side script execution (JavaScript), without depositing any cookie on the user's device.

Purposes of collection

  • Verification of compliance with contractual terms of use and subscribed plans (fraud and service misuse prevention)

No tracking cookies

No cookies are deposited on users' devices for behavioural tracking or advertising purposes. The only cookies that may be used are session cookies strictly necessary for the functioning of authentication, exempt from consent requirements pursuant to CNIL guidelines.

Liability & Hyperlinks

Publisher liability

The Publisher endeavours to ensure the accuracy, completeness and currency of the information published on this site. However, the Publisher cannot guarantee the accuracy, precision or exhaustiveness of the information made available and declines all liability for errors, omissions or results obtained through inappropriate use of such information.

Hyperlinks

This site may contain hyperlinks to third-party sites. The Publisher exercises no control over the content of these sites and accepts no responsibility for the information, products or services offered therein. The existence of a hyperlink shall not constitute an endorsement of the target site's content by the Publisher.

Force Majeure

The Publisher's liability shall not be engaged in the event of a force majeure event within the meaning of Article 1218 of the French Civil Code, i.e. any event that is unforeseeable, irresistible and external to the Publisher's will, preventing the performance of obligations. Force majeure events include in particular: natural disasters, acts of war or terrorism, pandemics, national network infrastructure outages, government decisions and telecommunications operator failures.

Article VIII

Applicable Law & Jurisdiction

These legal notices are governed by French law. The language of these notices is French, which shall prevail over any translation in the event of a discrepancy of interpretation. In the event of a dispute, and after any prior attempt at amicable resolution, French courts shall have exclusive jurisdiction.

Pursuant to the provisions of French law n°94-665 of 4 August 1994 on the use of the French language (Loi Toubon), these legal notices are drafted in French, which shall prevail over any translated version in the event of a discrepancy of interpretation.

Article IX

Modifiability & Digital Services Act

These legal notices and the present service are subject to change over time, in accordance with applicable legal and regulatory requirements and the development of the service.

Modifiability of legal notices

The Publisher reserves the right to modify, at any time and unilaterally, the content of these legal notices, in particular in order to comply with any applicable legislative, regulatory, case law or technical developments. The version in force is the one published on this site at the date of consultation, identified by its last update date. Users are advised to consult these legal notices regularly.

Regulation (EU) 2022/2065 — Digital Services Act

In accordance with Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services (DSA), which entered into application on 17 February 2024, the Publisher undertakes to comply with the obligations incumbent upon it as a provider of intermediary services. As the present service is exclusively intended for professional businesses (B2B), the specific consumer-protective provisions of the DSA do not apply in the context of contractual relationships established with professional clients.
