These GTU define the conditions of access and use of the ApsionScan platform, a SaaS stock management and traceability solution. They apply to all users, whether accessing via a free trial or a paid subscription.
The provider reserves the right to refuse access, restrict features or suspend an account in case of abuse, fraud, prohibited automated use or non-compliance with these GTU.
The free trial is available to anyone wishing to discover the service. It does not constitute an acquired right and may be refused, limited or terminated at any time.
The provider may, in the future, block certain account creation methods, including disposable email addresses or any other means encouraging abusive use.
Using the service requires creating an account. The user undertakes to provide accurate, complete and up-to-date information. Each account is strictly personal.
The number of authorised users depends on the plan subscribed to by the client company. Exceeding plan limits may result in:
The service must be used solely for the client's professional business needs, in a lawful manner consistent with its purpose. The user undertakes to use the service fairly, reasonably and in accordance with these GTU.
The user and client company are solely responsible for content, data and documents deposited, transmitted or processed via the service. Content must relate to a legitimate professional use.
The following are strictly prohibited, without this list being exhaustive:
The provider reserves the right to detect and analyse abusive use, including by examining usage patterns, IP addresses, devices, operating systems, and any relevant technical or behavioural signals.
Upon detecting abnormal behaviour, the provider may send a warning, request supporting documents, restrict access or take any appropriate measure.
The provider may suspend or delete an account immediately and without notice in case of serious abuse:
For minor breaches, the provider may send prior notifications, reminders or warnings. Any refund for a deleted paid account is governed by the GTS.
The user undertakes not to compromise the security, integrity or proper functioning of the service. Any confirmed or suspected compromise must be reported to the provider without delay.
The provider may reset access credentials, temporarily suspend features or impose additional security measures if required to protect the service or its users.
All elements of the service remain the exclusive property of the provider: code, software, architecture, interfaces, graphic elements, documentation and distinctive signs.
Only a limited, personal, revocable, non-exclusive and non-transferable right of use is granted within the normal use of the service. No ownership right is transferred to the user.
Upon expiry of a trial, termination, deletion or end of contract, the following rules apply:
For free trials: the account is blocked for writing at the end of the trial. The client has two (2) additional months to subscribe, with warning notifications sent. After this period, access is permanently cut off except for exceptional recourse. Data is retained for up to six (6) months total from the end of the trial before permanent deletion.
Early data deletion may occur in case of legal obligation, security threat or serious misconduct.
The user is solely responsible for their use of the service. The provider cannot be held liable for non-compliant, abusive, illegal or inappropriate use. The service is provided on a best-effort basis, without guarantee of continuous availability.
The provider reserves the right to modify these GTU at any time. The applicable GTU are those in force at the date of use of the service, or at the date of the relevant renewal or acceptance.
These GTU are governed by French law. In case of dispute, the parties shall seek an amicable solution. Failing agreement, jurisdiction is assigned to the competent courts of Narbonne.
