General Termsof Use

These General Terms of Use (GTU) define the conditions of access and use of the ApsionScan website and platform. They apply to all users of the service, including during a free trial.

Subject Matter & Service Access

Purpose of the GTU

These GTU define the conditions of access and use of the ApsionScan platform, a SaaS stock management and traceability solution. They apply to all users, whether accessing via a free trial or a paid subscription.

Access modes

  • Via a free trial
  • Via a paid subscription reserved for professional users

The provider reserves the right to refuse access, restrict features or suspend an account in case of abuse, fraud, prohibited automated use or non-compliance with these GTU.

Art. III

Free Trial

The free trial is available to anyone wishing to discover the service. It does not constitute an acquired right and may be refused, limited or terminated at any time.

Strictly prohibited practices

  • Robots, automated scripts and circumvention mechanisms
  • Creating multiple accounts to bypass the trial limit
  • Disposable email addresses or any means favouring abusive use
  • Any fraudulent behaviour or conduct contrary to these GTU

The provider may, in the future, block certain account creation methods, including disposable email addresses or any other means encouraging abusive use.

Art. IV — Art. V

User Account & Plans

User account

Using the service requires creating an account. The user undertakes to provide accurate, complete and up-to-date information. Each account is strictly personal.

  • Accurate, complete and up-to-date information required
  • Login credentials must remain strictly confidential
  • Responsibility for all activity carried out from the account
  • Immediate notification of any compromise or unauthorised use

Authorised users per plan

The number of authorised users depends on the plan subscribed to by the client company. Exceeding plan limits may result in:

  • A reminder or regularisation request
  • Technical restriction of access
  • Account suspension

Authorised Use & Content

Authorised use

The service must be used solely for the client's professional business needs, in a lawful manner consistent with its purpose. The user undertakes to use the service fairly, reasonably and in accordance with these GTU.

User content and data

The user and client company are solely responsible for content, data and documents deposited, transmitted or processed via the service. Content must relate to a legitimate professional use.

Prohibited content

  • Unlawful or fraudulent content
  • Illegally obtained data
  • Content contrary to public order
  • Content unrelated to a legitimate professional use
  • Content intended to infringe third-party rights or service security
Art. VIII

Prohibited Behaviour

The following are strictly prohibited, without this list being exhaustive:

1Use of robots, scripts or unauthorised automated tools
2Scraping the platform or bulk data extraction
3Any attempt to circumvent technical or contractual limitations
4Reverse engineering, decompilation or unauthorised analysis of the service
5Resale, sub-licensing or commercial exploitation for unauthorised third parties
6Unauthorised public benchmarks or load/security tests
7Introduction of viruses, malware or malicious code
8Any unauthorised access attempt to service systems or data
9Any use contrary to applicable laws and regulations
Art. IX — Art. X

Abuse Detection & Suspension

Abuse detection

The provider reserves the right to detect and analyse abusive use, including by examining usage patterns, IP addresses, devices, operating systems, and any relevant technical or behavioural signals.

Upon detecting abnormal behaviour, the provider may send a warning, request supporting documents, restrict access or take any appropriate measure.

Suspension & deletion

The provider may suspend or delete an account immediately and without notice in case of serious abuse:

  • Fraud or fraudulent behaviour
  • Use of bots or automated scripts
  • Scraping or bulk data extraction
  • Intrusion attempt or security breach
  • Serious breach of the GTU or GTS
  • Manifestly unlawful or misappropriated use

For minor breaches, the provider may send prior notifications, reminders or warnings. Any refund for a deleted paid account is governed by the GTS.

Art. XI — Art. XII

Security & Intellectual Property

Security

The user undertakes not to compromise the security, integrity or proper functioning of the service. Any confirmed or suspected compromise must be reported to the provider without delay.

The provider may reset access credentials, temporarily suspend features or impose additional security measures if required to protect the service or its users.

Intellectual property

All elements of the service remain the exclusive property of the provider: code, software, architecture, interfaces, graphic elements, documentation and distinctive signs.

Only a limited, personal, revocable, non-exclusive and non-transferable right of use is granted within the normal use of the service. No ownership right is transferred to the user.

Art. XIII

End of Access & Data Fate

Upon expiry of a trial, termination, deletion or end of contract, the following rules apply:

  • 1The account is blocked or closed
  • 2Data remains readable per the rules set out in the GTS
  • 3A data export may be carried out depending on available features
  • 4Data is retained for six (6) months after contract end to allow retrieval
  • 5After this period, data is permanently deleted

Art. XIII — Essai gratuit

For free trials: the account is blocked for writing at the end of the trial. The client has two (2) additional months to subscribe, with warning notifications sent. After this period, access is permanently cut off except for exceptional recourse. Data is retained for up to six (6) months total from the end of the trial before permanent deletion.

Early data deletion may occur in case of legal obligation, security threat or serious misconduct.

Art. XIV — Art. XVI

Liability, Modifications & Applicable Law

User liability (Art. XIV)

The user is solely responsible for their use of the service. The provider cannot be held liable for non-compliant, abusive, illegal or inappropriate use. The service is provided on a best-effort basis, without guarantee of continuous availability.

GTU modifications (Art. XV)

The provider reserves the right to modify these GTU at any time. The applicable GTU are those in force at the date of use of the service, or at the date of the relevant renewal or acceptance.

Applicable law (Art. XVI)

These GTU are governed by French law. In case of dispute, the parties shall seek an amicable solution. Failing agreement, jurisdiction is assigned to the competent courts of Narbonne.
